Welcome to Outpaintly, an Image Resizer service (“Platform”, “Service”, “we”, “our”, or “us”). These Terms & Conditions (“Terms”) govern your access to and use of the Outpaintly website, tools, and related services.

By creating an account, purchasing credits, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Description of Service

Outpaintly is an AI-powered image processing platform designed for image expansion and outpainting, while preserving a natural appearance.

Features may include:

  • AI image expansion and resizing
  • Batch image processing
  • Credit-based image generation
  • Downloadable processed images
  • Future automation and integrations

We may add, modify, suspend, or discontinue features at any time.

2. Eligibility

You must be at least 18 years old, or the legal age required in your jurisdiction, to use the Service.

By using the Platform, you confirm that:

  • You have legal authority to accept these Terms
  • Information provided during registration is accurate
  • You will use the Service only for lawful purposes

3. User Accounts

To access certain features, you may be required to create an account.

You agree to:

  • Keep login credentials confidential
  • Maintain accurate account information

4. Credits, Pricing & Payments

Credits:

  • Credits are consumed when images are processed
  • Credit amounts and pricing appear on our pricing page
  • Unused credits do not expire
  • Credits have no cash value and are non-transferable

Payments:

Payments are processed through a third-party provider (Stripe.com), to ensure the highest protection and security of your credit card details. When processing your payment, we do NOT have access to any of your financial information.

5. Refund Policy

Due to the computational nature of AI image processing and immediate delivery of digital services:

  • Processed images and consumed credits are generally non-refundable
  • Refund requests may be reviewed individually for technical failures or duplicate charges
  • We reserve the right to issue credits instead of monetary refunds

6. User Content & Ownership

“User Content” includes images, files, artwork, listings, text, and other materials related to your data.

You retain ownership of your content.

you grant Outpaintly a limited, non-exclusive license solely to:

  • Process images
  • Generate resized outputs
  • Store files temporarily
  • Operate and improve the Service

This license ends when your content is deleted, subject to backup retention periods.

7. AI Generated Outputs

Processed images generated by the Platform belong to you.

However:

  • You remain responsible for ensuring your use complies with copyright, trademark, publicity, and other applicable laws

8. Acceptable Use Policy

You agree NOT to use the Service to upload, process, create, or distribute:

  • Copyright-infringing materials
  • Illegal content
  • Offensive, abusive, or harmful content
  • Malware or malicious files
  • Content violating privacy or publicity rights
  • Content intended to deceive buyers

You further agree not to:

  • Reverse engineer the Platform
  • Scrape or copy system functionality
  • Bypass limits or security controls
  • Resell access without permission
  • Use automated bots that overload infrastructure

9. Intellectual Property

The Platform, including software, interface designs, AI workflows, branding, logos, code, documentation, and related materials remain our exclusive property.

You receive a limited, non-exclusive, revocable license to use the Service.

10. Relationship Disclaimer

Outpaintly is an independent service.

11. Service Availability

We aim to maintain reliable service availability but do not guarantee uninterrupted access.

The Service may be unavailable because of:

  • Maintenance
  • Infrastructure issues
  • Third-party provider outages
  • AI processing delays
  • Force majeure events

The Service is provided on an “AS IS” and “AS AVAILABLE” basis.

12. Limitation of Liability

To the maximum extent permitted by law, Outpaintly shall not be liable for:

  • Lost profits
  • Lost sales
  • Business interruption
  • Image inaccuracies
  • Marketplace policy violations
  • Data loss
  • Indirect or consequential damages

Our total liability shall not exceed the amount paid by you during the previous twelve (12) months.

13. Indemnification

You agree to defend and indemnify Outpaintly from claims arising from:

  • Uploaded content
  • Intellectual property disputes
  • Violation of these Terms
  • Illegal use of the Service
  • Third-party claims related to your outputs

14. Data Retention & Deletion

Your images may be stored temporarily for processing purposes.

We may automatically delete generated images after a retention period.

Users are responsible for downloading and backing up outputs.

15. Termination

We may suspend or terminate accounts if:

  • These Terms are violated
  • Fraud or abuse is detected
  • Payment obligations are unmet
  • Continued access poses operational risk

You may stop using the Service at any time.

16. Changes to These Terms

We may update these Terms periodically.

Changes become effective when posted on the Platform.

Continued use after updates constitutes acceptance.
